About the Legal Age Checker (India)
Indian law ties dozens of rights and protections to age: you become a major at 18 (Majority Act s.3), can vote from 18 on a roll’s qualifying date, can marry at 18 (women) or 21 (men), drive a 50 cc motorcycle at 16, a car at 18 and a transport vehicle at 20, and stand for the Lok Sabha at 25, the Rajya Sabha at 30 and the presidency at 35. Below 18 the Juvenile Justice Act and the POCSO Act treat you as a child; below 7 nothing you do is an offence.

How ages are counted
The Majority Act, 1875 s.3(2) says that in computing age, the day of birth is included as a whole day, and majority is attained at the beginning of the eighteenth anniversary of that day — so a person born on 15 August 2008 is a major from the start of 15 August 2026. The checker applies the same anniversary rule to every threshold. For someone born on 29 February it takes 1 March as the anniversary in a year without 29 February; the law does not say, so take advice if a deadline turns on that one day.
For the electoral roll, age is checked on the qualifying date — 1 January, 1 April, 1 July or 1 October of the year in which the roll is prepared or revised (Representation of the People Act, 1950, ss.14(b), 19). For a seat in Parliament or a State Legislature, the returning officer checks qualification on the date fixed for scrutiny of nominations (Representation of the People Act, 1951, s.36(2)(a)).
Legal ages at a glance
- Under 7: nothing done is an offence (BNS s.20). 7 to 12: no offence without sufficient maturity of understanding (BNS s.21).
- 6 to 14: right to free and compulsory education (Constitution Art. 21A; RTE Act s.3) — and after 14 for a child admitted under the Act, until elementary education is complete (s.4). Under 14: no employment in any occupation, with narrow exceptions; 14 to 18: no hazardous work (Child and Adolescent Labour Act ss.3, 3A).
- 16: motorcycle up to 50 cc (Motor Vehicles Act s.4(1)); for heinous offences, the Juvenile Justice Board’s preliminary assessment (JJ Act s.15).
- 18: majority; contracts; wills; voting; marriage for women; other motor vehicles; buying tobacco; the end of “child” status under the JJ and POCSO Acts.
- 20: transport vehicles (Motor Vehicles Act s.4(2)).
- 21: marriage for men; Panchayat and Municipality seats (Arts. 243F, 243V); firearms (Arms Act s.9).
- 25: Lok Sabha and State Legislative Assemblies. 30: Rajya Sabha and Legislative Councils. 35: President, Vice-President and Governor.
- 60: senior citizen under the Maintenance and Welfare of Parents and Senior Citizens Act s.2(h).
Marriage below the legal age
A marriage in which the woman is under 18 or the man under 21 is a child marriage. It is voidable at the option of the party who was a child, by a petition to the district court filed before that party completes two years after attaining majority (Prohibition of Child Marriage Act s.3); Karnataka has amended the Act so that child marriages solemnised after its amendment are void. An adult man who marries a child, and anyone who performs, conducts, abets, promotes or permits a child marriage, commits an offence (ss.9–11).

- State laws: the legal drinking age is set by each State’s excise law and differs between States, as do some licensing and tenancy rules.
- Eligibility set by rules or employers: recruitment age limits for government jobs and the armed forces, insurance, banking or school admission.
- Personal law questions beyond the statutes listed, and anything that depends on proof of age — the checker takes the date of birth you enter.

What is the legal age of adulthood in India?
18. Every person domiciled in India attains majority on completing 18 years — at the beginning of the 18th anniversary of the day of birth (Majority Act, 1875, s.3). From then a person can make a binding contract (Contract Act s.11) and a will (Succession Act s.59).
When can I register to vote?
When you are 18 on a qualifying date — 1 January, 1 April, 1 July or 1 October of the year the roll is prepared or revised (Representation of the People Act, 1950, ss.14(b), 19). The checker shows the first qualifying date on or after your 18th birthday.
What is the legal age of marriage in India?
Eighteen for women and 21 for men, under the Prohibition of Child Marriage Act s.2(a), the Hindu Marriage Act s.5(iii) and the Special Marriage Act s.4(c). A marriage below these ages is a child marriage, voidable at the option of the party who was a child.
At what age can I get a driving licence?
At 16 for a motorcycle of up to 50 cc, at 18 for other motor vehicles and at 20 for transport vehicles such as taxis, buses and goods carriages (Motor Vehicles Act s.4). A learner’s licence is issued only for a class you are old enough to drive (s.4(3)).
Can a 16- or 17-year-old be tried as an adult?
Only for a heinous offence — one with a minimum punishment of seven years or more. The Juvenile Justice Board first makes a preliminary assessment of the child’s mental and physical capacity and understanding; if it finds a need, it can transfer the trial to the Children’s Court (JJ Act ss.15, 18(3)). What counts is the age on the date of the alleged offence.
What is the minimum age to contest elections?
21 for a Panchayat or a Municipality, 25 for the Lok Sabha or a State Legislative Assembly, 30 for the Rajya Sabha or a Legislative Council, and 35 for President, Vice-President or Governor (Constitution Arts. 243F, 243V, 84, 173, 58, 66, 157).
Why is the drinking age not shown?
Because there is no single national drinking age: each State sets it in its own excise law, and the ages differ. Check your State’s excise Act.
